Terms of Service

These terms govern your use of Kakavaanen (kakavaanen.com), operated by Aleksandar Donchev, a sole trader based in the United Kingdom. By creating an account or purchasing credits, you agree to these terms.

1. The Service

Kakavaanen provides an AI-powered image generation platform. Registered users can generate and edit images using credits. Free accounts receive a starting credit allowance. Additional credits can be purchased.

2. Eligibility

You must be at least 18 years old and based in the United Kingdom to purchase credits. The platform is available to users worldwide for free-tier access, but paid features are restricted to UK residents only.

3. Credits and Payments

• Credits are sold in packs. The current rate is 5 credits for £1.00 (minimum purchase 25 credits / £5.00, maximum 125 credits / £25.00).
• Credits are non-transferable and have no cash value.
• Payments are processed securely by Stripe. We do not store your card details.
• Credits are granted automatically after successful payment via webhook.
• Credits do not expire, but are tied to your account and cannot be refunded once used.

4. Refunds

Unused credits may be refunded within 14 days of purchase, in line with UK consumer rights for digital services. Credits that have been used to generate images are non-refundable. To request a refund, contact us at admin@kakavaanen.com.

5. Acceptable Use

You agree not to use Kakavaanen to generate images that are:

• Illegal under UK law
• Sexually explicit or pornographic
• Defamatory, harassing, or intended to harm a specific individual
• Infringing on third-party intellectual property rights

We reserve the right to suspend accounts that violate these rules without refund.

6. AI-Generated Content

Images are generated by third-party AI models (OpenAI). We do not guarantee specific outputs. Generated images may be used for personal or commercial purposes, subject to OpenAI's usage policies. We make no claim of ownership over images you generate.

7. Service Availability

We aim to keep the service available but do not guarantee uninterrupted access. We are not liable for losses caused by downtime, errors, or changes to third-party AI services.

8. Limitation of Liability

To the extent permitted by law, our liability is limited to the value of credits purchased in the 30 days prior to any claim.

9. Changes to These Terms

We may update these terms. Continued use of the service after changes constitutes acceptance. Material changes will be communicated by email.

10. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
